Online Gambling

A modern method of gambling that allows players to place wagers on games for the chance of winning money. It can only be done in the presence of an internet connection. Unlike in brick and mortar casinos, online gambling offers a different experience and bonuses that make the activity fun and exciting. Common forms of online gambling are sports betting, casino games, slot games, lottery. Players deposit funds to their registered accounts and withdraw their winnings via popular methods such as UPI, NetBanking, Credit cards, and Debit cards.

Online casinos in India are featured with Indian classic and traditional games such as Teen Patti, Rummy, Andar Bahar. Most Indian players are familiar with these card games and as they are ruled as games of skills they have an element of luck. Other popular online gambling games are Blackjack, Baccarat, Roulette, and Indian Flush.

These online games are not available online for Indians to download and play because Google company updated its new policy on gambling apps. It outright restricts Indian-based gambling apps. Countries not restricted are the United States, New Zealand, Mexico, Canada, Sweden, Spain, Japan, Germany, Finland, Denmark, Norway, Romania, Spain, and Colombia.

Google took to follow the Indian state government ban on such apps. Earlier in October, the Karnataka state government banned Paytm first games and ruled it illegal. Google did the necessary and blocked them stating they violated the terms of services.

Is Online Gambling part of Online gaming?

iGaming is a fun and leisure activity that has multiplayer features and also outsiders can live stream the action. Gambling involves betting money and having monetary transactions between players or between a player and an online casino. The difference is the aspect of Money.

Online games can be downloaded from Apple Store or Google Play Store for free. Literally, everyone has one or two games on their phone that they play while on the bus, or just when bored. They do not require you to pay any money only your knowledge and skills.

In online gambling games, a player has to deposit some money to be able to open games and play. There is a tiny aspect of skills and knowledge in most gambling games. The games are featured with the element of luck and probability.

The gambling laws in India classify gambling in two: games of skills and games of chances. And according to the state government games that involve luck are ruled illegal by the Supreme Court. But here’s the catch, games of skill are legal. Some games have the element of skill and chance at the same time hence very confusing on if it is legal or not. The game of Rummy has ruled a game of skill stating it requires strategy and skills to play and has to be experienced to win.

The legality of online games varies between different states in India. Gambling is regulated at the state level and national level. On a national level, The Public Gambling Act of 1867, The Information Technology Act of 2000, and The Prize Competition Act of 1955 were constituted years ago. And the gambling era has been on the rise in the new era generation of millennials. Although there are new reports on current laws that regulate online gambling in India.

Some states in India have imposed bans on online gambling apps and sites. A hefty fine would be charged to anyone caught gambling online or even face imprisonment. Also, gambling games and site developers are being watched. States that placed the bone are Andra Pradesh, Tamil Nadu, Punja, and Telangana, and recently the Karnataka state enforced the law banning games of chance or games that require players to deposit money to earn money.

Let’s see what the Law says about gambling

All forms of gambling are forbidden under The Public Gambling Act of 1867. The Act was enacted in an era before online gambling, therefore some are not certain if it also applies to online gambling. All forms of prize competitions where they are offering a prize in more than 1000Rs per month are restricted by The Prize Competition Act. Games like the Lottery and Slot machines with progressive jackpots are considered misleading. In 2000, The Information Technology Act banned gambling without stating online gambling status. India lacks enough regulations that clearly address the acts of gambling in the country.

The state of Sikkim enacted a law under the Sikkim Online Gaming Act of 2008 stating that casino players can play certain online table games. However, together with Goa, they have a number of brick-and-mortar casinos.

Why should Online Gambling be Regulated in India?

The state government officials have opened conversations stating that online gambling has induced criminal behavior among their youth. They went further to state that there has been an increase in the number of organized crimes like identity theft, cybercrimes, money laundering, and fraud.

Clearly, the act negatively affects some parts of the Indian community. However, the country’s confusing gambling laws are harming its own economy. The gambling industry generates revenue for the country and instead, the money is collected by offshore sites that have found ways to attract Indian players.

Regulating the industry will mean that the country will be able to detect any risks early, and find ways to control gambling. With the state involved, it’s easier to identify the number of people addicted to gambling and help them.

Future of Online Gambling in India

It is evident that the industry will keep flourishing and become popular globally. The Indian states refuse to embrace these changes to protect their citizens from crimes, bankruptcy, and unstable mental problems. Therefore it may take a while before one single state steps forward and declares they will regulate the industry and make it legal. Maybe then other states will follow.

CONCLUSION

With the growth of the industry, we would be confident to say that the inside states are not far from legalizing and regulating the gambling industry in their country, till then gambling is illegal in India.
